If Kleinig’s five factors provide an ethical appraisal for the use of acceptable force, Neyroud and Beckley (2001) contend that this is just part of the justification for the use of force and they identify a further three issues:

the methods of force deployed;

the competence of the officer;

the strategic, legal and societal framework (this has been discussed throughout the chapter).

Methods of force

Neyroud and Beckley (2001) argue that there is a range of coercive resources that represent a continuum of force from communication to lethal options. While the five factors of Kleinig’s ethical assessment must be applied in each case to ensure that the force is justified, Neyroud and Beckley state that, in incidents where use of force is deployed, these incidents often escalate through that continuum. Therefore, an incident may commence with communication between a police officer and suspect, and escalate to use of physical force and a taser gun being deployed. The decision at which level the force is deployed is dependent on the behaviour of the suspect, the situational context, the information known about the suspect, the suspect’s response to initial police contact and the coercive resources available to the police officers. But the level of force must be absolutely necessary and proportionate to the situation.
